Freedom Downtime

00:00:23 All we can do is try to publicize the facts.
00:00:26 Not what the government is saying,
00:00:29 And not simply parrot or regurgitate...
00:00:33 what the government's saying,
00:00:41 lt was the dead of winter.
00:00:43 l don't remember it ever being so cold.
00:00:46 And we were on a mission.
00:00:48 A bunch of us had volunteered
00:00:52 the Schuylkill Federal Prison
00:00:56 He called himself Phiber Optik.
00:00:58 You'd have to look hard to find someone
00:01:04 Before we left, we had a night of fun...
00:01:06 in the streets of Philadelphia,
00:01:10 Phiber learned by exploring.
00:01:12 He was never too busy to explain...
00:01:13 howthings worked to anyone interested.
00:01:15 l think that's what pissed of
00:01:18 They never tried to prove that
00:01:22 They got him for conspiracy...
00:01:23 for talking on a tapped phone line...
00:01:25 about howto hack certain sites.
00:01:27 There were people who broke into systems...
00:01:29 and fucked things up,
00:01:32 The feds didn't care.
00:01:33 They wanted to shut down the teachers,
00:01:38 There's Bernie S.
00:01:39 He's another guy who loves to explain...
00:01:41 howtechnology works
00:01:44 He didn't know it, but hell
00:01:49 We made one last stop
00:01:51 lt was a town called Frackville.
00:01:53 We thought it was funny because
00:01:56 We thought it'd make a good picture
00:01:59 But Bernie had the balls
00:02:01 to pose with Phiber.
00:02:03 These guys had no clue
00:02:05 but they quickly got into the spirit.
00:02:11 lt was the last time we laughed that night.
00:02:15 We drove to the prison.
00:02:17 lt felt like it was 20 degrees below zero.
00:02:19 We didn't know
00:02:21 for the entire weekend.
00:02:25 And like the gullible idiots we were...
00:02:28 we figured we'd have a chance
00:02:31 We didn't.
00:02:34 They grabbed him.
00:02:35 And we had to run out of there
00:02:45 Phiber came home 10 months later, a hero.
00:02:47 Everyone knew
00:02:49 was a big mistake.
00:02:51 After it was over, we were pretty sure
00:02:56 Were we ever wrong.
00:03:23 Bad boys gone to jail
00:03:27 Bad boys gone to jail
00:03:31 Look at you, boy, you've come of age
00:03:35 and now you're going around
00:03:39 You say that you'll never go to jail
00:03:43 'Cause you're so bad and you cannot fail
00:03:47 Oh bad boy
00:03:51 Oh bad boy
00:03:55 Oh bad boy
00:04:00 Gots to believe me one time
00:04:03 You went to town just to fool around
00:04:07 You met a girl who was wearing a frown
00:04:11 You going around, boasting, feeling bad
00:04:15 Now you're sitting in jail
00:04:17 don't you feel so sad
00:04:19 This is like the crudest form
00:04:24 1, 2, 3, 4, 5.
00:04:33 l just saw something.
00:04:36 Was that you? Well, we can see your hand.
00:04:39 l doubt you can stick your whole head
00:04:42 Splotch your face up against the window
00:04:44 We'll know it's the right one,
00:04:47 We'll know it's the right one,
00:04:48 Kevin Mitnick, the world's most dangerous
00:04:53 My regret about Cyberpunk
00:04:56 and how he was always eating
00:05:00 People have really gotten on my case
00:05:03 Some guy came up to me
00:05:07 ''Why did you go on and on
00:05:09 And he was right.
00:05:11 l did that to the point
00:05:16 Where it was sort of...
00:05:19 just beating an issue
00:05:21 For a period
00:05:24 and released into a halfway house...
00:05:26 l couldn't find a single article...
00:05:27 that talked about him
00:05:32 And the real fascination with Kevin's body...
00:05:35 and its relationship to technology..
00:05:37 is one of the things
00:05:40 l found a number of articles in Time,
00:05:44 written by people like Markoff
00:05:48 And they would say
00:05:50 where he no longer touched a computer,
00:05:55 As if those two things were connected.
00:05:57 1988, USA Today...
00:06:00 put his picture on the front page...
00:06:02 morphed or superimposed
00:06:06 And l thought this is
00:06:10 and it's really picking up on the idea
00:06:13 lf ever there was someone
00:06:17 The mention of his name was enough
00:06:20 Over the years, his reputation grew
00:06:24 ln numerous articles, Kevin was said to have
00:06:28 harassed actress Kristy McNichol...
00:06:30 and turned his friends'
00:06:34 His beginning was on ham radio.
00:06:37 And on ham radio,
00:06:41 A couple of dozen people at the most
00:06:47 And, you know,
00:06:51 And, of course,
00:06:53 ''Let's challenge him, let's do this and that.''
00:06:55 When he met their challenges,
00:06:59 as if they were innocentvictims of Kevin's.
00:07:02 This has been the case throughout.
00:07:04 And then people
00:07:08 other contacts that they had.
00:07:09 ln one case there was a lieutenant
00:07:16 One ham radio operator
00:07:18 got him to write a letter saying Kevin
00:07:23 And all sorts of crazy things in his past.
00:07:25 Cyberpunk was published in 1991...
00:07:25 Cyberpunk was published in 1991...
00:07:28 by Katie Hafner
00:07:30 and relied almost entirely
00:07:33 who Kevin had had a falling out with...
00:07:35 as well as those who didn't know him at all.
00:07:38 Hafner and Markoff never talked to Kevin,
00:07:42 But it didn't take much to dispel the rumors.
00:07:44 NORAD denied any break-ins...
00:07:47 Kristy McNichol had no idea
00:07:49 and no evidence ever surfaced
00:07:53 But none of this ever got printed.
00:07:55 Kevin's name was enough to convict him,
00:08:00 And then there was Security Pacific.
00:08:02 After being hired,
00:08:05 because of the stories that followed him.
00:08:07 And this resulted in
00:08:11 There was a Newswire article coming out
00:08:15 that Security Pacific
00:08:19 in bad loans...
00:08:21 which would have affected their stock price.
00:08:23 That was actually tracked down
00:08:26 that someone made
00:08:28 lt had nothing to do with it not being true...
00:08:31 but it was an error that someone made
00:08:34 lmmediately, because there were
00:08:39 that knew Kevin Mitnick,
00:08:42 immediately that was attributed to,
00:08:46 And that's howthat rumor spread.
00:08:49 l'd seen this all before.
00:08:50 Hackers were always getting blamed
00:08:53 ln many cases
00:08:56 lt was obvious
00:08:59 somebody who would command respect.
00:09:02 Hackers break into government
00:09:05 stealing and destroying information...
00:09:06 raiding bank accounts,
00:09:09 extorting money by threats
00:09:14 Whoa, hold on a second.
00:09:16 What was this guy reading?
00:09:18 Hackers don't steal and extort,
00:09:22 Like those Simplex locks
00:09:24 ln typical corporate brainpower...
00:09:26 FedEx uses the same combination
00:09:29 lt's fun to stick something
00:09:32 that couldn't possibly fit in the chute
00:09:35 And he got some cheap beer out of it too.
00:09:38 lf you go somewhere
00:09:40 and bring something back to show people...
00:09:43 that always struck me
00:09:47 And you know, panty raids are really...
00:09:50 in the grandest tradition of this country
00:09:53 Try to make your way in there...
00:09:55 get the stuff, and get back out with it
00:09:59 What we're doing here is we're talking...
00:10:02 on McDonald's external speaker
00:10:06 And what we're doing to do that...
00:10:08 is we have a modified ham radio...
00:10:11 meaning it transmits on frequencies
00:10:16 ln this case,
00:10:22 154.6 megahertz seems to be
00:10:28 l'll take your order.
00:10:29 The blonde, would you please
00:10:32 Could one of you take off your tops?
00:10:36 You bastards, you better stop being smart.
00:10:38 -Here comes the manager.
00:10:47 While corporateAmerica
00:10:50 it was mostly about fun and exploration,
00:10:54 But try telling that to corporateAmerica.
00:10:57 Kevin Mitnick had already paid
00:11:00 He had served a year-and-a-half in 1988...
00:11:02 for logging into DEC computers
00:11:05 By simply looking
00:11:07 DEC claimed he caused
00:11:10 and was sentenced as if he had caused
00:11:13 He was held without bail and was put
00:11:13 He was held without bail and was put
00:11:17 because they thought he could do
00:11:20 After his sentence, Kevin served
00:11:24 reporting to authorities every month...
00:11:26 and being restricted in where he could go
00:11:29 He only had days to go
00:11:32 he had violated the terms
00:11:34 by associating with Lewis DePayne...
00:11:36 and accessing someone's voice mail
00:11:39 lt was nothing.
00:11:41 But it was enough.
00:11:42 Knowing howthe media
00:11:44 would crucify him over any offense...
00:11:46 because he could start World War lll
00:11:49 Kevin decided to just walk away.
00:11:52 l was devastated.
00:11:54 We were never far away from each other.
00:11:58 And how was he living on his own...
00:12:01 without his family to share things with?
00:12:06 lt was horrible.
00:12:08 What kind of a life is this?
00:12:09 He is not streetwise.
00:12:13 He's a home person.
00:12:15 Kevin managed to avoid attention.
00:12:18 Then, on July 4, 1994, everything changed.
00:12:21 A front page story in the NewYork Times...
00:12:24 turned Kevin Mitnick into a household word
00:12:28 The evil-looking picture...
00:12:29 the mythical stories
00:12:32 and controlling all the telephones
00:12:34 even the Security Pacific news release tale
00:12:39 Nobody could figure out howthe story
00:12:43 since there was nothing new in the story
00:12:46 But the author was no stranger.
00:12:49 who was quickly becoming a Mitnick expert
00:12:53 We looked at the story
00:12:56 We were planning the first Hackers On
00:13:00 The story had gotten so big that
00:13:05 They came here to the Hotel Pennsylvania
00:13:08 These usually anonymous creatures
00:13:11 better known as hackers,
00:13:13 Throughout that weekend,
00:13:16 We all wished he could be there.
00:13:18 But we knew why he was running.
00:13:20 One of the things Markoff
00:13:23 was the eight months
00:13:25 The guy was in solitary confinement
00:13:31 Think about it.
00:13:32 l mean, that would definitely change a man.
00:13:35 You would run.You wouldn't want that.
00:13:37 lt was eight months, not for anything he did,
00:13:42 And if you get someone
00:13:44 of actually what he can do
00:13:48 lf you have someone
00:13:50 to put you in solitary confinement
00:13:53 lt makes perfect sense to me.
00:13:54 l think it's part hype...
00:13:56 part hysteria, part lack of understanding...
00:14:01 and part fear.
00:14:03 Solitary confinement means no books...
00:14:06 no pencil, no paper, no company.
00:14:09 Nothing to do...
00:14:11 but stare at these small four walls.
00:14:14 He would get out one hour a day..
00:14:18 and that's it.
00:14:19 You know, he might whistle up
00:14:22 That's a big problem
00:14:24 They get a little pissed off
00:14:28 The fear factor is just insane.
00:14:30 Once or twice or maybe more,
00:14:33 they didn't even bring him down
00:14:37 They took my daughter and l...
00:14:39 upstairs to a floor...
00:14:42 that wasn't occupied at that time.
00:14:45 We were the only ones there and the guard.
00:14:47 They were hovering over him...
00:14:49 as though he was an absolute monster
00:14:53 What could he possibly do, you know?
00:14:58 Could he make...
00:15:01 a computer out of the telephone?
00:15:05 l don't know what they were afraid of!
00:15:07 First of all, he had no desire to.
00:15:10 Secondly, it wouldn't have
00:15:13 Thirdly, he couldn't do it.
00:15:16 Kevin managed to elude the authorities
00:15:19 Then, on February 15, 1995...
00:15:22 they found him in Raleigh, North Carolina.
00:15:25 The FBl's most-wanted computer hacker
00:15:29 Kevin Mitnick was jailed without bond
00:15:32 where he was arrested this week.
00:15:34 He's accused of breaking into
00:15:38 Private computer experts say
00:15:42 that privacy is virtually impossible.
00:15:45 The FBl had managed to track Kevin...
00:15:47 with the help of a mysterious
00:15:50 who, along with some friends
00:15:53 Kevin's cellular phone signal
00:15:56 One of Shimomura's friends who was there
00:16:00 was none other than John Markoff...
00:16:02 who wrote an even bigger
00:16:05 Sure enough, l opened the door,
00:16:08 to the hotel room,
00:16:12 And l picked it up and l just thought,
00:16:16 This article had a new list of things
00:16:20 including breaking into
00:16:23 leaving nasty voice mail messages...
00:16:25 and stealing 20,000 credit card numbers...
00:16:28 something that was mentioned
00:16:32 But 13 paragraphs later, on Page D17...
00:16:36 it was revealed that he had never used
00:16:38 They were credit card numbers
00:16:41 by lnternet Service Provider Netcom
00:16:45 Netcom credit card file,
00:16:48 lf you didn't have that file, you were a loser.
00:16:50 Hundreds of people had that,
00:16:54 And then they claim that he's the one
00:16:58 when that was floating around for months
00:17:02 Everybody and his sister's
00:17:04 What's the big deal?
00:17:09 What l want to know...
00:17:12 is did he threaten anybody in any way?
00:17:14 Did he claim he was going to do
00:17:17 Are there any notebooks
00:17:21 to conspire to commit any particular thing...
00:17:25 other than humiliating
00:17:28 which any idiot who's ever met Shimomura
00:17:31 this was not the guy to mess with.
00:17:34 l met Shimomura once.
00:17:35 The first time l met Shimomura
00:17:38 And l was testifying
00:17:41 and there's this guy...
00:17:43 in sandals and, like, ragged-ass cutofs.
00:17:47 And the rest of us are done up in ties...
00:17:49 it's me and theAttorney General
00:17:51 And we're sitting there, giving our best
00:17:56 And Shimomura is there in this surfer gear.
00:18:00 And he pulls thisAT&T cell phone...
00:18:03 pulls it out of the shrink-wrap,
00:18:06 and starts monitoring phone calls...
00:18:09 going up and down Capitol Hill...
00:18:11 while an FBl agent
00:18:15 l'm like, ''This fucker's got balls
00:18:19 You know, this is unbelievable.
00:18:24 l mean, he's hacking, right?
00:18:26 He was finger-hacking this phone
00:18:29 with two FBl agents
00:18:33 in the room with him.And l was like,
00:18:37 l mean, l was impressed.
00:18:38 lnside of a week, Shimomura and Markoff
00:18:41 estimated to be worth $750,000.
00:18:44 lt would be another 19 months
00:18:47 The book, entitledTakedown,
00:18:51 When l read it, l was aghast.
00:18:55 lt was Tsutomu's
00:19:00 l'd been to a lot of the restaurants
00:19:02 but l didn't need a hacker book
00:19:05 Takedown. Well....
00:19:09 l don't what l want to say aboutTakedown.
00:19:13 Takedown was not well received.
00:19:19 1996 came and went as did 1997.
00:19:23 Kevin remained in prison
00:19:25 and no prospect of a trial anytime soon.
00:19:29 A25-count indictment
00:19:31 than lying on the telephone
00:19:34 and copying software which he
00:19:37 Nothing about hacking
00:19:39 or having 20,000 credit card numbers...
00:19:42 nothing that would have appeared
00:19:46 North Carolina had also charged him
00:19:50 Kevin was given a two-year sentence...
00:19:52 more than he would have gotten
00:19:54 But the federal charges still remained.
00:19:57 They even put him
00:19:59 because the authorities were convinced
00:20:03 sneak into the warden's office
00:20:07 The mainstream media made light of it...
00:20:09 claiming Mitnick was put in solitary
00:20:13 What everyone seemed to forget
00:20:15 and this guy had yet to be tried.
00:20:17 And then, things got a whole lot worse.
00:20:20 June 1998.
00:20:20 June 1998.
00:20:22 A movie version of Takedown
00:20:24 Skeet Ulrich, who played a killer in Scream...
00:20:27 was set to play Kevin Mitnick.
00:20:28 And Russell Wong
00:20:30 would be Tsutomu Shimomura.
00:20:32 lt didn't seem to matter to anyone...
00:20:34 that the real-life Kevin
00:20:37 According to the script
00:20:40 he had been found guilty
00:20:42 The magic of Hollywood.
00:20:45 They even brought
00:20:47 ln real life, they'd only met
00:20:50 ln the Hollywood version
00:20:52 where Kevin would proceed
00:20:55 with a garbage can lid.
00:20:57 We had to tell the world
00:20:59 The truth needed to be told.
00:21:01 And we could either do it ourselves,
00:21:04 That's right, the media,
00:21:06 committed to informing the public
00:21:09 The true conscience of America.
00:21:12 -Stop pushing!
00:21:16 Watch yourselves!
00:21:19 Come on, guys.
00:21:22 Don't yell at me, everyone's in front of me.
00:21:24 Tell them to come back.
00:21:26 He's coming to the mike!
00:21:31 Would you guys get down?
00:21:38 Watch the mikes!
00:21:41 Let's get out of the way.
00:21:48 Come on.
00:21:57 We decided to do it ourselves.
00:21:59 We found Skeet Ulrich's apartment
00:22:02 and paid a visit
00:22:04 But he had moved.
00:22:05 l know, because the doorman let me
00:22:10 So the next stop was Miramax Films
00:22:13 We figured they'd appreciate a chance
00:22:17 And we knew we'd be warmly received
00:22:20 The company had distributed
00:22:23 you know, the guy
00:22:30 Hi, we're looking for Miramax?
00:22:35 -What's your name?
00:22:37 Who you here to see?
00:22:38 Sorry, you can't film in here.
00:22:40 -You can't film here?
00:22:43 Sorry, you can't....
00:22:44 So there's no way you can call upstairs....
00:22:49 You have to call them, they will call me.
00:22:53 This wasn't going well.
00:22:54 How could a movie company
00:22:57 All we wanted to do was talk to somebody.
00:23:03 What a letdown.
00:23:04 His light is on, so he's capturing everything.
00:23:06 So please go outside
00:23:09 All right, we don't want that,
00:23:12 We called the office and waited
00:23:16 lt was like they were scared of us.
00:23:20 that hackers were as one-dimensional
00:23:23 How could we get them
00:23:26 That night, NewYork City
00:23:29 We decided to find out
00:23:33 so we could let people in for free.
00:23:43 This is what the hacker world
00:23:46 Why didn't they see this?
00:23:47 Why did it always have to be something evil
00:23:55 We had only one option.
00:23:57 ''For Off The Hook,
00:23:59 ''where you got the copy of a script
00:24:02 ''l found it really amusing
00:24:05 ''and not twist it or fabricate it,
00:24:10 l've heard about Kevin's story,
00:24:13 l heard about this meeting,
00:24:16 and see how l can help.
00:24:17 lt wasn't from me, it's from somebody else,
00:24:20 -ls there a good catchiness?
00:24:25 ''Three-and-a-halfYears With No Trial.''
00:24:28 And then you can make another one,
00:24:33 ''And No Trial.''
00:24:34 When they see two ''Free Kevin'' stickers...
00:24:37 when they see 10, 20, 100,
00:24:42 They'll keep saying it
00:24:44 One or two people that know more about it
00:24:48 Those two people get two people
00:24:51 We're gonna be in their face
00:24:54 lf it comes to showing this thing
00:24:57 we're going to be there, too.
00:24:59 l mean, what we're doing now
00:25:03 until Kevin has his trial, until Kevin is out.
00:25:06 ''Guilty by Hollywood''
00:25:08 -That's a good one.
00:25:12 Yeah, l did look at the script, and....
00:25:15 l don't know.
00:25:16 lt's a shame and it definitely
00:25:20 for someone
00:25:23 to then see this movie
00:25:27 We had tried talking to them
00:25:30 Now, by having a demonstration outside
00:25:34 But we were hackers.
00:25:36 Just that they can turn into riots...
00:25:38 especially when the Mayor
00:25:41 and the cops shoot people a lot more.
00:25:44 We needed guidance,
00:25:47 We looked all over town for an activist.
00:25:49 Maybe one of those gray-haired hippies
00:25:52 We found one. Sort of.
00:26:05 What's it like demonstrating here?
00:26:08 They hate our guts because
00:26:11 Why do you think there isn't more activism?
00:26:14 Because people don't care, they're scared...
00:26:17 they're afraid they'll get into trouble.
00:26:21 But we still have to take a stand,
00:26:24 We have to at least give it a try,
00:26:27 -Has this cop been giving you any trouble?
00:26:31 And we have a President
00:26:35 That bothers a lot of people, but....
00:26:37 Anybody that's decent gets bothered
00:26:43 Or when a President
00:26:45 Yeah.
00:26:47 He wasn't exactly what we had in mind.
00:26:49 l got a real earful about
00:26:52 But in the end,
00:26:55 When you demonstrate,
00:26:59 And that's the one thing we were sure of:
00:27:06 The day arrived.
00:27:15 We just stood there for a while,
00:27:18 Our converted phone company van
00:27:20 My name is Noah Kenickstein,
00:27:23 -For Miramax?
00:27:26 l didn't even know.
00:27:27 -l'm a lawyer. l'm representing you all.
00:27:31 So, no one's getting arrested, right?
00:27:34 -l didn't plan on it.
00:27:37 The National Lawyers Guild
00:27:40 and that was the turning point.
00:27:42 Things began to come together.
00:27:45 lt seemed like everyone except Miramax
00:27:49 We learned that when you stand outside
00:27:53 people notice.
00:28:04 These folks are gonna
00:28:07 They're gonna be marching around.
00:28:10 -You could tell the....
00:28:12 Tell the precinct, and tell them l'm a lawyer
00:28:17 No problems at all.
00:28:19 But they're having a little....
00:28:22 -l've got it.
00:28:24 l appreciate thatvery much.
00:28:27 l would say there's gonna be....
00:28:32 50 to 60, maximum 50.
00:28:38 -What area are you doing it in?
00:28:42 They're demonstrating about a movie
00:28:45 Thanks a lot, l appreciate you stopping me.
00:28:47 Everybody's nice and calm.
00:28:49 -l'll tell them that. Thanks for the advice.
00:28:53 No, they're not gonna come on purpose.
00:28:56 People are, you know....
00:28:57 You're talking about suits.
00:29:00 They don't give a fuck.
00:29:03 Don't harass the people who walk by
00:29:06 Some people have crises
00:29:08 They can't be bothered with our problems.
00:29:12 Do you have a permit?
00:29:16 Do you all have a permit?
00:29:18 As long as you don't block
00:29:21 You stay to the side, please.Thank you.
00:29:25 They can walk in front.
00:29:29 As long as you don't block the entrance,
00:29:33 They have a FirstAmendment right.
00:29:36 Don't block the entrance.
00:29:38 lt's ringing. l got put in voice mail,
00:29:41 This one's reaching voice mail.
00:29:45 Hi, this is the protest outside.
00:29:48 lf you get this, come outside.
00:29:51 l see someone.
00:29:53 All right. Maybe you'll pick up the phone
00:29:56 You calling the Publicity Department?
00:29:58 No, the main number.
00:30:01 and l asked for directions to the protest...
00:30:04 and they told me they couldn't get me
00:30:08 l said, ''Okay, l'll call you back tomorrow
00:30:11 -l see them, they've got their heads out.
00:30:14 They're not answering the phones.
00:30:16 Waving banners that said ''Free Kevin''...
00:30:18 and holding ''Stop Miramax'' posters...
00:30:20 the small butvocal crowd of protesters...
00:30:22 stood outside Miramax Pictures'
00:30:26 At issue: this script, entitledTakedown...
00:30:29 the story of the nation's most notorious
00:30:33 Mitnick is currently being held in prison
00:30:36 awaiting trial on computer crimes.
00:30:38 lt's a script these Kevin Mitnick supporters
00:30:41 and would hurt Mitnick's chances
00:30:44 lt might influence the jury
00:30:46 lt might change a lot of things
00:30:49 He's trying so hard to at least
00:30:53 where he's constantly being defamed.
00:30:57 You never know who you might see
00:31:02 Kevin Bacon had no interest whatsoever.
00:31:07 But radio personality Lazlow did.
00:31:09 With the proliferation of the news...
00:31:13 TV news journalism like Primetime Live...
00:31:15 and these shows
00:31:21 and shows like 60 Minutes
00:31:27 people don't knowthe facts about the case.
00:31:29 They don't knowthe facts about hackers.
00:31:33 l'd say that hackers...
00:31:36 are the communists of the 1990s...
00:31:38 where, basically, if anybody says ''hacker''...
00:31:42 all of a sudden you've got this demon 666 across
00:31:46 Nobody actually understands any of it.
00:31:50 What l do in my part, on the radio...
00:31:55 with my syndicated show,
00:31:58 because l talk to a lot of old people,
00:32:02 When l can, l put Emmanuel or Bernie S.,
00:32:07 to talk about the state of what's going on,
00:32:11 The people who cover it
00:32:13 do so for profit,
00:32:16 The demonstrators say they have sent
00:32:20 to Kevin Mitnick in jail,
00:32:24 Miramax's parent, Disney,
00:32:27 The controversy comes on the heels...
00:32:28 of the dumping of $43 million
00:32:31 by the Texas Board of Education.
00:32:33 The board's complaint: Miramax films
00:32:37 Miramax distorts the facts!
00:32:45 Was that Harvey Weinstein,
00:32:48 He walked right by us.
00:32:49 He didn't even get
00:32:52 Of course we had a brochure for Harvey.
00:32:55 Okay, l'll talk to you later. Bye.
00:32:59 -What did they say?
00:33:02 There she is.
00:33:04 She hung up on me yesterday
00:33:06 l got through.
00:33:07 They waved. Did you see them wave?
00:33:10 Miramax distorts the facts!
00:33:12 They said if you use a bullhorn...
00:33:14 or obstruct people's walkways,
00:33:18 Miramax distorts the facts!
00:33:20 lf you continue to use that,
00:33:26 l think that three years is a long time
00:33:30 And l think that what Miramax is doing...
00:33:33 is going to jeopardize his right
00:33:38 So that's why l'm out here protesting.
00:33:40 Thank you.
00:33:44 They all were aware of the thing
00:33:47 They talked about it on the set,
00:33:50 They said ''Did you talk to Emmanuel?
00:33:51 They were waving. They think it's fantastic.
00:33:53 And they all want Free Kevin stickers.
00:33:56 lf you give me some, l will send it to them.
00:33:59 Hello, sir.
00:34:00 Hello, sir.
00:34:02 No, l do not.
00:34:03 Computer hacker who's been in jail
00:34:08 Miramax has decided
00:34:10 The script is false.
00:34:15 which he is not.
00:34:17 l want to know what you think about it.
00:34:19 When are they doing the film?
00:34:20 -They start shooting in a few weeks.
00:34:23 -How do l find out the truth?
00:34:27 -Hold on, l want to talk to you.
00:34:29 My main thing is the only reason
00:34:34 is because people don't have
00:34:37 All you got is big corporations like Miramax
00:34:42 FirstAmendment! Yeah!
00:34:45 This is inAmerica.
00:34:46 -He was in jail three years without a trial?
00:34:49 l saw something about this
00:34:52 This happens a lot, though.
00:34:54 You always have unauthorized biographies
00:34:58 Where it's like, you have an autobiography...
00:35:00 you have an authorized biography.
00:35:03 -This is sort of like an unauthorized--
00:35:07 -He hasn't had a trial yet?
00:35:10 Not only that, in the movie,
00:35:15 -You ever hear of Kevin Mitnick?
00:35:18 Well, if you're walking away, l really can't....
00:35:23 How did you guys get a hold of the script?
00:35:27 Okay. All right.
00:35:31 You're a lawyer.
00:35:35 Can't they try and stop them
00:35:38 That's not right.They have to put a waiver--
00:35:40 l think they should hold the film
00:35:44 l mean, it happens.
00:35:47 You know, l don't think it should be....
00:35:49 Obviously, it's probably not legal
00:35:53 l think they should have to wait
00:35:56 And also they shouldn't use his real name.
00:35:58 lf they want to change the facts,
00:36:01 -Make it a fictional story.
00:36:04 Think about what you've done
00:36:08 And imagine being in jail
00:36:13 For just that. Just for copying software.
00:36:18 l've copied software.
00:36:20 -What did he do? He hacked.
00:36:23 l would like to know your opinion...
00:36:25 on the slandering in this film.
00:36:31 Miramax sucks. So, like, Free Kevin!
00:36:37 l can't talk shit about a movie
00:36:42 But the one relevant thing that l could say..
00:36:44 is it seems to me there is
00:36:49 vis-a-vis hacking, you know.
00:36:51 People are very quick to fly off the handle
00:36:55 people who are, you know,
00:36:59 in a way that they don't understand.
00:37:01 -Definitely.
00:37:05 Not only did we find a receptive bunch
00:37:07 they even started to do our work for us.
00:37:10 New York was great.
00:37:12 New York was great.
00:37:13 We had to travel to get to the right people.
00:37:17 and made sure none of us had anything
00:37:21 We charted out a course,
00:37:24 That's where we got our economy-sized
00:37:27 The plan was to go
00:37:30 where filming for Takedown
00:37:32 On the way, we figured we'd make a detour
00:37:35 the annual hacker convention in Las Vegas.
00:37:38 lf we were going to do that,
00:37:40 to say hi to Tsutomu Shimomura...
00:37:42 and maybe convince him
00:37:45 And if we did that,
00:37:48 to ask him to inject some accuracy
00:37:52 Since we were suddenly adding
00:37:55 we might as well visit
00:37:57 who were claiming Kevin Mitnick
00:38:01 just to see what the hell they were talking about.
00:38:06 There's something about Pennsylvania.
00:38:09 That's because they seem to have prisons
00:38:14 And almost everyone l know who's gone
00:38:18 Weird.
00:38:20 Besides, every time l get pulled over
00:38:22 l seem to find myself in the Prison State.
00:38:26 Let's not get off on the wrong foot,
00:38:29 Home of such landmarks as the Liberty Bell,
00:38:34 that little surveillance camera
00:38:41 and the house where Thomas Jefferson
00:38:45 just down the block from theAfro-American
00:38:51 A maximum-security federal prison
00:38:56 Howtimes change.
00:39:00 They say it's illegal to take pictures
00:39:03 even those under construction,
00:39:06 We couldn't find a law anywhere
00:39:09 but try taking a picture of a prison...
00:39:11 without getting threatened
00:39:14 Here, look at this part.
00:39:16 Maybe there are subtle details
00:39:29 l think fully half of the people
00:39:33 shouldn't be there.
00:39:35 lt's notviolent criminals.
00:39:39 Drug crimes. Somebody gets
00:39:42 for selling $800 worth of LSD.
00:39:45 That's not right either.
00:39:49 lt's just not right.
00:39:50 l knowthe state of California
00:39:55 lncarceration is a big business.
00:40:01 There is less and less tolerance
00:40:04 for people who have transgressed the rules.
00:40:06 We have a huge prison population.
00:40:11 Putting a computer hacker in
00:40:15 is probably the worst thing
00:40:18 to somebody who has...
00:40:21 not murdered, is not a violent criminal!
00:40:24 Somebody who's a technological....
00:40:27 Then, again,
00:40:30 We need a new classification system
00:40:34 ln one of my books
00:40:37 especially for technology
00:40:42 and the judges
00:40:45 would have some technological basis...
00:40:48 to evaluate and try the case
00:40:51 and to come up with
00:40:54 that reflected more the nature of the crime.
00:40:57 lf you're exposed to people like that
00:41:00 You become one of them.
00:41:03 Next thing you know you'll be locked away
00:41:07 One night...
00:41:12 ...l was in my cell in a minimum-security
00:41:16 Two guards stormed in...
00:41:19 and flipped my bed upside down...
00:41:22 and locked me in handcufs and started
00:41:27 demanding to know
00:41:30 l'm like, ''l don't have a computer here.
00:41:34 They were squeezing the toothpaste
00:41:36 ostensibly looking for a computer
00:41:40 lt was bizarre!
00:41:43 But Pennsylvania was more than prisons,
00:41:46 And theAge Expo was where
00:41:50 that corporateAmerica
00:41:59 The guy representing BellAtlantic
00:42:02 How could you not trust a fox?
00:42:04 Freddie the Phone-Fraud Fox was passing
00:42:08 Over $4 billion in phone fraud every year.
00:42:11 Freddie said most of that was
00:42:15 And l met him.
00:42:19 Freddie knew words like ''digit''
00:42:23 lt made more sense to say things like
00:42:25 lt means they will have to dial
00:42:28 along with their seven-digit number
00:42:31 within and between 215, 610...
00:42:36 and the new 267 for 215...
00:42:39 and the 484 for 610 area code.
00:42:43 You give them out in blocks of 10,000 and people
00:42:47 end up using 300 numbers
00:42:51 Easy listening
00:42:57 Easy listening
00:43:02 Easy listening
00:43:07 Easy listening
00:43:13 lgnore the poisoned atmosphere
00:43:15 Open up another beer
00:43:18 The media feeds you every day
00:43:23 We went back...
00:43:28 ...to a familiar place.
00:43:32 Everything was just as we left it...
00:43:35 only it was about 90 degrees warmer.
00:43:37 But you could still feel the chill
00:43:43 lt was surprising
00:43:46 So we filmed everything.
00:43:49 the minimum-security prison camp...
00:43:51 the sign that lets minimum-security
00:43:54 and Unicor, the slave-labor office...
00:43:56 where prisoners make furniture
00:44:03 We almost made it out.
00:44:12 lt was the first time we had ever gotten
00:44:19 How could we not drop in
00:44:21 the Computer Emergency Response Team?
00:44:23 They tell the world
00:44:26 They'd back us up and tell the world...
00:44:28 that Kevin Mitnick
00:44:30 Kristy McNichol, or theAmerican way of life.
00:44:33 We thought computer people
00:44:35 but these guys
00:44:37 We asked the security guard to come down
00:44:44 Something must get triggered
00:44:47 We were meeting far too many cops
00:44:50 But at least Pennsylvania
00:44:57 We explained why we were there
00:45:01 You're not welcome.
00:45:03 We're used to that.
00:45:04 ln the event that you should
00:45:09 if you are not welcome...
00:45:11 and l find out that you are not welcome...
00:45:13 you will be exactly where Kevin is...
00:45:19 and then you'd be defeating your purpose.
00:45:22 l'm here to do the job
00:45:26 -to get you out of here.
00:45:28 l know a lot of people who are in prison
00:45:32 But that's our judicial system.
00:45:34 You know what l mean?
00:45:36 Sometimes it works and sometimes it don't.
00:45:40 Believe me, l've seen it not work
00:45:45 l'm gonna parlay the rest of this...
00:45:48 my tedious job is to run you for wants
00:45:54 if you would expedite your leaving.
00:45:57 We'll get out of here,
00:46:00 19 radio.
00:46:04 The gentleman has been given
00:46:08 l'll give you his name and stuf.
00:46:13 Before we left,
00:46:17 He told me not to mess with her.
00:46:20 She did everybody she could in the weeds...
00:46:23 and then she moved to the projects.
00:46:26 lt's not Kevin's fault.
00:46:27 Free Kevin. Kevin has nothing to do with it.
00:46:30 The broad quit me
00:46:34 and l wasn't making no money.
00:46:38 l was broke, that's why she quit me.
00:46:40 The reason l don't have a girlfriend
00:46:47 Oh, wow.
00:46:48 He seems like a nice guy.
00:46:53 You think his girlfriend's gonna quit him
00:46:56 lt was time to go.
00:47:02 We was peeling potatoes
00:47:05 Back in World War Two
00:47:08 And we was playing that rock and roll
00:47:15 Hidden from the public
00:47:17 lt was behind the scenes
00:47:20 There was a relic
00:47:47 With Kevin Mitnick locked away...
00:47:48 the phone companies of the world
00:47:51 But the fact remained,
00:47:54 online and off.
00:47:56 Allied SignalAerospace...
00:47:58 Sprint PCS up there...
00:48:00 lnformix,
00:48:03 You're scaring me.
00:48:06 lt's like this flat area where there's no trees
00:48:12 Oklahoma, the state that created Hanson.
00:48:16 People kept telling us our sound guy
00:48:20 Since we were going through
00:48:23 we figured we'd go
00:48:25 and turn the Free Kevin campaign
00:48:28 We could use the publicity..
00:48:30 and if we could confuse some Tulsans
00:48:33 all the better.
00:48:34 And it sure wasn't hard to do that.
00:48:49 Once we'd confused people at the mall,
00:48:53 in the hopes that the Religious Right
00:49:01 When the vice president of the university,
00:49:04 came down the stairs with a golf club,
00:49:08 There wasn't a golf course for miles.
00:49:10 Hellflower, Satan's power
00:49:14 You grow more beautiful by the hour
00:49:18 You feed our hearts
00:49:21 With the essence of the souls
00:49:33 Shrinking violet makes the scene
00:49:36 ln the formal garden of the queen
00:49:40 Bloody Mary, so contrary
00:49:43 They had a hard time getting into my place.
00:49:46 l had the bedroom door closed,
00:49:50 They were pounding on the door
00:49:53 They actually started calling
00:49:56 and leaving messages
00:49:58 ''This is the FBl.
00:50:01 l wasn't there when they searched my home.
00:50:05 My dad was the only one home.
00:50:08 that he was me.
00:50:09 They were looking for somebody
00:50:12 When they found out that l was like, 13...
00:50:17 they didn't know what to do.
00:50:19 l think when they walk in
00:50:22 they should be told to go to hell...
00:50:23 take what they want, we'll see you in court,
00:50:28 The problem, of course, is that
00:50:32 They want to try to get off cheap...
00:50:34 so they cooperate and they plea bargain...
00:50:37 and they end up pleading guilty
00:50:40 And that sets the record bad
00:50:44 l think if people had the resources,
00:50:48 dedicated to helping people,
00:50:52 You know, something that's much more
00:50:56 such as the EFF.
00:50:57 An organization that's actually truly willing
00:51:02 that we'd see a lot more progress
00:51:06 The government, for once...
00:51:07 would have to start conforming
00:51:10 that they're supposedly enforcing.
00:51:12 We were detained for two hours
00:51:15 There were 13 police officers
00:51:20 l told them what was going on...
00:51:22 but they seemed to think
00:51:26 Without my consent
00:51:29 even though they admitted
00:51:32 They took anything and everything
00:51:35 or had an electrical plug on it.
00:51:37 They took other unrelated items
00:51:41 l'm not quite sure howthat fits
00:51:44 Every business card l had.
00:51:47 They took everything
00:51:50 They told me they're not trying
00:51:54 and then one of them said...
00:51:56 he used to play with baseball cards
00:52:00 They would be searching my wardrobe.
00:52:01 l'd be standing there with the guy
00:52:04 and he's going through every pocket
00:52:07 Then it suddenly dawned on me...
00:52:08 l don't have to stand there.
00:52:11 He stopped searching the wardrobe
00:52:14 lt was very obvious.
00:52:16 Their tactics weren't meant
00:52:19 Searching every pocket
00:52:23 that tactic wasn't meant to do anything
00:52:27 They showed up at my friend's house...
00:52:29 where a 3-year-old and a 5-year-old
00:52:32 They came storming into the house
00:52:35 ran up the steps...
00:52:37 and said,
00:52:41 l was sitting at the keyboard of a computer,
00:52:45 l was thrown to the floor, handcuffed,
00:52:49 and dragged out. l told my..
00:52:51 friend Ellen Fisher, who was there,
00:52:56 They kept telling me to shut up.
00:53:00 l was taken back to the police station
00:53:04 and locked in a cell for about three hours
00:53:11 Then a Secret Service agent
00:53:14 or interrogated me, wanted to know
00:53:17 And l said l was making them
00:53:23 He tried to get me to say l was
00:53:27 He gotvery irate that l wasn't telling him
00:53:30 Eventually they locked me
00:53:33 They refused to let me call my lawyer.
00:53:35 ln fact, my rights weren't read to me.
00:53:37 There were many instances
00:53:39 l wanted to consult with my attorney...
00:53:41 and they said, ''That's not a good idea.''
00:53:46 So finally, when...
00:53:47 they all shifted from my apartment
00:53:53 l got to drive down in my own car.
00:53:56 l called an attorney...
00:53:57 and by the time they were at my work,
00:54:01 The agent in charge, Ken McGuire,
00:54:04 gave me a very nasty
00:54:06 at the fact
00:54:09 lt's really amazing.
00:54:11 He really gave me one of these:
00:54:15 ''You shouldn't have done that'' looks.
00:54:18 NASA people told my parents l was cocky...
00:54:20 because l told them
00:54:23 l had cops tell me pretty well straight out:
00:54:26 ''We really didn't want to harm Junior..
00:54:29 ''so we took his computer
00:54:32 ''over in traffic management,
00:54:35 Wait a minute. You're like,
00:54:39 They were like,
00:54:43 ''Dad should have known better.''
00:54:45 So this is $4,000 worth of equipment
00:54:50 and you just pocketed it, basically?
00:54:53 Now you're going to charge him?
00:54:56 ''we've got to bring him up
00:55:00 ''he's gonna be a felon and be ruined.''
00:55:02 ''We explained this to them and they said,
00:55:07 But that's not legal.
00:55:09 That's nothing like legality
00:55:13 lt's blackmail, basically.
00:55:15 lt's like with anyone else.
00:55:20 doesn't give you the right to be an asshole.
00:55:22 Unless you'd like me to be an asshole
00:55:24 l don't care who you are.
00:55:27 You will obtain the respect from me
00:55:31 l may have hacked NASA, but who doesn't?
00:55:44 They say they clocked us
00:55:47 on the lnterstate in New Mexico.
00:55:49 And the cop wouldn't let us go
00:55:53 To make matters worse, he told us
00:55:58 Things seemed pretty bleak.
00:56:00 But, then, a miracle happened.
00:56:06 All right!
00:56:09 He said 11 hours
00:56:11 These highway patrol people
00:56:14 All right, Las Vegas, let's do it!
00:56:19 Twilight City gonna set my soul
00:56:25 Got a whole lot of money
00:56:28 So get those stakes up high
00:56:31 There's a thousand pretty women
00:56:34 They're all waiting, they're devil-may-care
00:56:37 And l'm just the devil
00:56:41 Viva Las Vegas
00:56:44 Viva Las Vegas
00:56:47 Viva Las Vegas
00:56:52 How l wish that there were more
00:56:58 Even if l ran out of speed, boy
00:57:02 We're looking for the Defcon conference.
00:57:04 We're supposed to be filming here.
00:57:06 Defcon conference?
00:57:08 lt's like computer hackers....
00:57:11 Not that l know of.
00:57:13 Were they gonna start inside the computer
00:57:17 lt's about a thousand computer hackers
00:57:22 l've never heard of it.
00:57:24 They must've done a good job
00:57:26 They even got me going.
00:57:28 Plaza Hotel, Las Vegas?
00:57:30 New Mexico.
00:57:35 lt was a mistake anybody could have made...
00:57:38 except nobody else seems to have made it.
00:57:40 At least if we were in New Mexico...
00:57:42 we could stop by LosAlamos National Labs,
00:57:46 and one of the many places
00:57:49 lf we could get the word to the people here,
00:58:10 ln those few places
00:58:13 we always seemed to stay a bit too long
00:58:16 we weren't supposed to be looking at.
00:58:20 This guy was mean,
00:58:23 As we left, we noticed
00:58:26 all around the building.
00:58:30 That's when we got lost on a dark road
00:58:34 with a bunch of military zealots
00:58:37 We got the message.
00:58:58 Twilight City gonna set my soul
00:59:01 lt's gonna set my soul on fire
00:59:04 Got a whole lotta money that's ready to burn
00:59:07 So get those stakes up high
00:59:10 There's a thousand pretty women
00:59:14 They're all waiting, they're devil-may-care
00:59:17 And l'm just the devil
00:59:20 Viva Las Vegas
00:59:24 Viva Las Vegas
00:59:27 Viva Las Vegas
00:59:31 How l wish that there were more
00:59:38 Even if l ran out of speed, boy
00:59:42 When l started,
00:59:45 l thought it was going to be a party
00:59:48 When we left, everybody said,
00:59:51 And l said, ''l guess l could do this again.''
00:59:54 Since then, more people get involved,
00:59:58 ''We could probably have some music.''
01:00:00 Next thing you know,
01:00:03 with LCD wall projectors and DJs coming in
01:00:16 lt has taken on this life of its own.
01:00:36 We are the Ghetto Hackers.
01:00:41 Low-class, low-budget, high-octane.
01:00:51 -Dead!
01:00:54 When l say rock, you say ass!
01:00:56 -Rock!
01:00:59 Thank you very much. Good night.
01:01:02 l have in my hand proof positive...
01:01:05 that NTis not the solution
01:01:09 l have captured earlier today on film...
01:01:12 the blue screen of death...
01:01:14 at Las Vegas' own
01:01:20 Thousands showed up.
01:01:21 Even though the Free Kevin stickers
01:01:24 at least everybody here knew his name.
01:01:29 You have to go to www.kevinmitnick.com.
01:01:36 ''And it doesn't matter
01:01:40 ''What matters is us.
01:01:42 ''What matters is....''
01:01:48 We were hot on the trail.
01:01:49 We were hot on the trail.
01:01:51 l don't want to get into Shimomura.
01:01:54 l think he has a very large ego.
01:01:56 He's a very bright person and very smart...
01:01:59 but l think his social skills are lacking.
01:02:03 For years, Shimomura had been eluding me.
01:02:06 l couldn't even get on the same TV shows.
01:02:09 He'd pop up over on CNN...
01:02:11 while l was stuck over
01:02:15 While he was getting all cozy
01:02:18 l was being interrogated by Mike Wallace.
01:02:23 2600: The Hacker Quarterly?
01:02:25 Tsutomu wasn't even answering my e-mail.
01:02:28 But nowthere would be no escape.
01:02:31 The San Diego Supercomputer Center,
01:02:34 We were closing in.
01:02:36 You notice how quiet it is?
01:02:40 Like when a deer
01:02:46 -You're here to see him?
01:02:50 -You're looking for Tsutomu?
01:02:51 -l haven't seen him in three months.
01:02:54 Do you know where he is?
01:02:57 He's not here.
01:02:58 Let me check with....
01:03:00 Did you make arrangements
01:03:02 They weren'tvery firm
01:03:07 -You can try his office.
01:03:10 -lt was very informal.
01:03:13 You can try the extension,
01:03:15 Do l know him?
01:03:18 Just from interacting on....
01:03:20 But l'm not.... l can't....
01:03:23 Definitely should have called first, l guess.
01:03:26 lt's just he likes surprises so much.
01:03:28 This sheet of paper
01:03:32 He'll know what it's about. He wanted
01:03:36 He wanted these?
01:03:38 l just wanted to make sure he got them.
01:03:42 lt wasn't much better than the reception
01:03:45 But we left our calling card in a place
01:03:51 l think it's absurd when l find out
01:03:55 is giving instructions to Skeet Ulrich...
01:03:59 on howto act more like Kevin.
01:04:01 Here's someone instructing him
01:04:05 and it's a person that met Kevin only once...
01:04:08 in court, under circumstances of duress.
01:04:12 From there how he can ascertain
01:04:17 When l step on this curb
01:04:30 Sorry to bother you.
01:04:33 We're not sure if we have
01:04:36 -Tsutomu Shimomura.
01:04:39 How long ago did he move?
01:04:41 -Seven, eight months?
01:04:43 Do you have any idea where he went?
01:04:44 No, he was renting,
01:04:47 He's in the national news.
01:04:50 -He's what?
01:04:53 -You can see, l'm on the phone.
01:04:56 -They're making a movie about him.
01:04:59 -lt's all about--
01:05:03 They're making a big
01:05:06 They may film around here
01:05:10 -So l could be a star?
01:05:12 l've been waiting to be discovered
01:05:15 He could be anywhere.
01:05:19 Man, that's scary.
01:05:21 We had one last address to try
01:05:24 But this was getting frustrating.
01:05:27 We have another lead here.
01:05:30 We're certainly seeing a lot
01:05:36 ''Out of order, please use other door.''
01:05:43 You know, if that was a computer,
01:05:53 They think we're
01:05:58 lt was like he was a step ahead of us.
01:06:02 Japanese? Long hair?
01:06:06 For some reason,
01:06:08 to have a full directory
01:06:11 available to anyone in the world.
01:06:14 But it gave us
01:06:17 Shimomura wasn't here either.
01:06:21 lt's a pretty cool system, though.
01:06:26 Let's try a couple of other things.
01:06:28 We're going to enter
01:06:36 Now it's dialing.
01:06:38 That's their whole phone number
01:06:44 See if we get an answering machine.
01:06:47 You've reached Amy.
01:06:50 Please leave a message.
01:06:53 We've gotten everything
01:06:55 and made ourselves look suspicious at
01:07:00 On the way out of San Diego,
01:07:01 On the way out of San Diego,
01:07:03 The trunk wouldn't close.
01:07:05 We should get this tape of the trunk, too.
01:07:09 Holy fuck! Oh, my God! Shit!
01:07:15 We're right underneath the flight path!
01:07:17 We had to clean everything out
01:07:20 including the disgusting piece of gum
01:07:24 You know what,
01:07:27 Okay, l'm down.
01:07:28 This is the most disgusting thing
01:07:32 You know it's still soft. Oh, God!
01:07:34 Want some gum?
01:07:42 This is a scary neighborhood.
01:07:45 We made it to LosAngeles
01:07:47 Our first stop,
01:07:50 where Kevin had been accused of storing
01:07:54 USC claimed that somehow caused
01:07:58 l wanted to know what computer system
01:08:00 by having files stored on it!
01:08:03 l'm Brian Johnson. l'm
01:08:06 Yeah, we're not allowed
01:08:10 At least we finally
01:08:12 who'd say they weren't allowed
01:08:14 That was progress, right?
01:08:17 The Metropolitan Detention Center
01:08:18 The Metropolitan Detention Center
01:08:20 where Kevin had been held
01:08:23 lt was his 35th birthday
01:08:25 The closest we could come
01:08:28 lt was a popular place for all the people
01:08:32 l know he's looking at me, so l can wave hi.
01:08:35 And he gives me a call
01:08:39 -He's comfortable with that.
01:08:43 Like, almost once a week.
01:08:45 When l drop off my sister
01:08:48 -How come you can't go in there and visit?
01:08:51 l wouldn't know why the reason
01:08:54 -You're his brother?
01:08:56 Married to my sister.
01:08:57 -So it's only immediate family?
01:09:01 He talks to me
01:09:04 -l just come and say hi.
01:09:07 l don't know what the reason why he's in,
01:09:13 And you bring your friends with you?
01:09:17 Yeah, they know my brother-in-law
01:09:19 We grew up together so....
01:09:22 Have you heard of Kevin Mitnick,
01:09:26 -l never heard of him.
01:09:28 -You know what computer hackers are?
01:09:30 He's been in there
01:09:34 -and he hasn't had a trial yet.
01:09:38 He's working on it, he's trying,
01:09:42 That's something true.
01:09:45 They're not the ones that--
01:09:49 Sure.
01:09:50 There's so many people, l think.
01:09:54 l wouldn't even know what to tell you,
01:09:58 He must've went in
01:10:00 He must've pissed somebody off.
01:10:02 Pissed somebody off
01:10:05 They probably laughed and said,
01:10:08 That's not fair but that's the way it is.
01:10:10 When the windows
01:10:13 it's hard to find
01:10:15 even if you know exactly what time to look.
01:10:18 And then we heard it.
01:10:26 Yeah, what was that?
01:10:27 l heard a pounding on the window
01:10:32 1,2,3,4,5.
01:10:40 He's shining a light or something.
01:10:49 l can see him now.
01:10:50 Was that you? That was you.
01:10:53 You were pounding on the glass, right?
01:10:57 We were looking at the wrong window.
01:11:00 Come back to the window
01:11:02 Can you do that?
01:11:04 We'll put a sticker up, we just don't want
01:11:08 He wants us to put a sticker.
01:11:10 -He wants a sticker?
01:11:12 We can see your hand.
01:11:13 l doubt you can stick
01:11:16 Splotch your face up against the window
01:11:18 Nowthat we know it's the right one,
01:11:21 All right, cool.
01:11:25 Okay, great. See you then. Bye.
01:11:29 He's going to be up there in two minutes.
01:11:32 l wish we could go in there
01:11:35 But, hell, l'll take it.
01:11:38 We found out that our filming
01:11:41 that every single prisoner
01:11:43 confined to their cell for the rest of the day
01:11:46 And Kevin told us
01:11:51 Like this.
01:11:57 That's cool.
01:12:03 Even the manager of the station
01:12:15 This guy in the blue car
01:12:18 No kidding.Thanks!That's great.
01:12:21 Look where l put the sticker.
01:12:24 lt'll be gone tomorrow.
01:12:26 -That's great.
01:12:28 -He let you do that?
01:12:29 Randolph's gonna get gas
01:12:33 He was never served...
01:12:37 with a warrant for his arrest...
01:12:39 for the supervised release violations
01:12:44 So by the time that he was done
01:12:50 there's no indication that he was aware
01:12:57 Damn! You know, Sprint really sucks.
01:13:00 We wanted the entire city
01:13:04 And what better way
01:13:06 on the most famous billboard in town?
01:13:12 lt took us hours to climb that thing.
01:13:15 We honestly didn't knowthere was a road
01:13:19 But we made it.
01:13:21 Funny thing, though.
01:13:22 We couldn't find anybody
01:13:27 Later, we went
01:13:30 to try and spread the word from up close.
01:13:38 Here, Free Kevin! Free Kevin Mitnick.
01:13:41 lt won't bite you. Speak English?
01:13:43 We're trying to get the message
01:13:45 that it's wrong to release
01:13:49 that's based on real events....
01:13:50 People will see this movie
01:13:53 when so much of it
01:13:56 -l've heard about this guy.
01:13:57 Here, help stop a movie
01:14:03 -You got a problem?
01:14:05 Come back and tell me about it.
01:14:07 Pussy!
01:14:10 lt's hard to believe
01:14:12 could be in jail for three-and-a-half years,
01:14:17 no bail, no trial.
01:14:19 l don't find thatvery hard to believe.
01:14:21 -l read a book, Takedown.
01:14:23 l read like half of it.
01:14:26 He gets out of jail,
01:14:30 That's the problem.
01:14:33 You don't think he could hack anything
01:14:36 He can't hack anything
01:14:39 l mean, you gotta have
01:14:41 Why are you recording this?
01:14:43 Hey, read about Kevin Mitnick?
01:14:48 He's the best guy ever!
01:14:51 Yeah, me too, yo!
01:14:59 He's never done anything wrong,
01:15:03 and he's being treated
01:15:05 That is theAmerican way. Wake up.
01:15:09 Kevin was denied bail. Even a bail hearing.
01:15:14 lf you recall,
01:15:18 His bail was turned down.
01:15:22 On the other hand, Kevin...
01:15:25 is getting treatment that is outside the law
01:15:29 And that's what makes itvery difficult
01:15:34 He's not being treated in a legal manner
01:15:38 l've never heard of anything
01:15:43 ...confinement prior to a trial.
01:15:46 Murderers get bail.
01:15:49 Armed robbers get bail.
01:15:52 The fear of what he's going to do...
01:15:54 from a push-button telephone
01:15:58 shows again a lack of technical
01:16:02 and judicial system.And l think that's sad.
01:16:05 And he is right nowthe victim of that.
01:16:10 On our way up the coast,
01:16:11 On our way up the coast,
01:16:13 According to a letter we got our hands on...
01:16:15 they said Kevin's acquisition
01:16:17 represented hundreds of millions
01:16:20 Nowthey give
01:16:23 Something wasn't right.
01:16:24 So we're right here.
01:16:25 On the other side of the freeway
01:16:30 And then further up is their big campus.
01:16:32 Basically, all of this blank area...
01:16:36 is actually Sun buildings and Sun streets.
01:16:39 We knew where we were,
01:16:42 What number do we call
01:16:44 1-800-USA4SUN.
01:16:46 They can direct you to whoever you need.
01:16:49 USA4SUN?
01:16:50 Can you remember
01:16:53 The receptionist wouldn't let us talk
01:16:56 But we slipped a few leaflets
01:16:59 l thought she was being kind of patronizing.
01:17:01 ''Do you want me to write that down
01:17:04 l can remember it.
01:17:08 USA4SUN, right?
01:17:10 -Was that it? Or was it SUN4USA? Fuck!
01:17:13 You sure?
01:17:15 Should l run in and ask her again?
01:17:18 ''Thank you for calling Sun.''
01:17:26 l have a rotary phone.
01:17:35 l'm pressing zero.
01:17:40 l'm probably going to get her,too.
01:17:44 My call ''may be monitored.''
01:17:48 Another machine.
01:17:53 They want my eight-digit lD number!
01:17:57 This is bullshit, man.
01:18:00 They've got me waiting
01:18:03 lt's not exactly what l had in mind.
01:18:06 But let's see what happens.
01:18:09 My call is ''very important to them.''
01:18:14 He hung up!
01:18:16 He hung up on me!
01:18:18 Maybe he didn't hang up on me
01:18:21 Fuck!All right.
01:18:25 l think on their web page
01:18:28 But we're not on their web page,
01:18:33 Wait a minute.
01:18:36 -Not today.
01:18:38 Shit. We can't access the web from here...
01:18:40 we're outside Sun
01:18:42 to find out what their phone number is!
01:18:46 l'm gonna try this number one more time.
01:18:48 l'm gonna be a little patient here.
01:18:53 Okay, now l am waiting
01:18:59 Hi, Pete, my name is Emmanuel.
01:19:01 l'm trying to reach somebody
01:19:04 l'm hoping somebody can contact me
01:19:09 and how it involved Sun.
01:19:12 We came to the corporate headquarters
01:19:15 and they gave us a phone number
01:19:19 so if you could get back to me....
01:19:21 They have a fortress here.
01:19:23 They have that mighty guard there
01:19:28 And then the voice mail guard here...
01:19:30 that won't let anybody actually call
01:19:33 Maybe they'll call back, maybe they won't.
01:19:36 This is the red hotline.
01:19:40 We have GPS, good.
01:19:42 GPS but no modem. Man, that sucks.
01:19:46 l was using it last night and it was gone
01:19:50 Sorry, no cameras in front of the building.
01:19:52 How about if we film in that direction?
01:19:55 We can't have the cameras filming.
01:19:57 Okay, 'cause we were just filming us.
01:19:59 No, l can understand that,
01:20:02 Wow, this was a new one.
01:20:04 We couldn't even film ourselves
01:20:07 Corporate paranoia was at an all-time high.
01:20:10 And, needless to say,
01:20:13 Meanwhile, John Markoff
01:20:14 Meanwhile, John Markoff
01:20:16 Maybe now we'd finally get some answers.
01:20:19 We made it to San Francisco
01:20:21 that psychologists from around the world
01:20:24 Maybe because so many people
01:20:27 They have counseling phones
01:20:29 because so many people
01:20:31 But San Francisco was a friendly town...
01:20:33 where people felt safe
01:20:36 But more importantly...
01:20:38 the psychologists wound up taking
01:20:46 even the old-fashioned ones.
01:20:50 We were beginning to get desperate.
01:20:55 Then we found a hotel
01:20:58 We never did find out why.
01:21:02 Markoff mentions certain stories.
01:21:05 He'll say, ''lt's been said that....''
01:21:09 And he'll come up with these stories
01:21:14 shut off power.... lt's bullshit.
01:21:16 l don't think John Markoff
01:21:21 But l think he did it
01:21:26 Maybe he believed
01:21:28 Okay, isn't a newspaperman...
01:21:30 supposed to investigate something
01:21:35 before they put it in the newspaper as fact?
01:21:38 l know Spencer Tracy
01:21:45 We didn't know what we were walking into.
01:21:50 that would shock and horrify us?
01:21:52 how much his front-page stories
01:21:55 helping to put him in the lousy place
01:21:58 This was our one chance
01:22:01 And, more than anything,
01:22:04 So we came up with the Markoff Meter.
01:22:08 and resolved not to judge him badly
01:22:12 And if he said six good things...
01:22:14 well, then, the hacker world
01:22:18 Maybe this wouldn't be so bad.
01:22:25 Nowthere's an easy point
01:22:29 l wanted to get to the heart of the matter
01:22:31 Like howthey knew it was Kevin
01:22:36 When l called the Qualcomm guys,
01:22:39 And the FBl believed that it was Kevin
01:22:43 Why?
01:22:46 l don't know enough
01:22:50 inside the FBl investigation.
01:22:52 That's a good question. l don't know why
01:22:54 But the FBl told the Qualcomm people
01:22:58 And, to my mind, as a reporter,
01:23:01 -Which is what?
01:23:03 Really good social engineering.
01:23:05 But there are thousands
01:23:07 That's true.
01:23:09 l'm not saying it's proof.
01:23:11 l'm simply saying
01:23:14 Did they hear a voice
01:23:18 Did they have a voice recording?
01:23:22 This we couldn't forgive.
01:23:24 Before you print front-page stories
01:23:28 shouldn't you have
01:23:31 What did Kevin do that was diferent?
01:23:33 He had a reputation
01:23:38 l've heard some tapes,
01:23:42 lf he in fact was the person
01:23:46 then he was a good social engineer.
01:23:50 Nowthat's better. No need to be stingy
01:23:54 One thing that's been following
01:23:56 since the first story Markoff wrote about him
01:24:01 When you say something like that
01:24:05 And in Kevin's case,
01:24:09 So where did the NORAD stuff come from?
01:24:12 The NORAD stuff...
01:24:14 is stuff that l got from someone...
01:24:17 who was in legal trouble
01:24:20 So l have not been able to interview Kevin
01:24:24 l've heard he said that it's inaccurate
01:24:28 The story did come from a friend of his.
01:24:31 l knowthere are lots of stories
01:24:35 But what stories have stuck?
01:24:37 l remember the Kristy McNichol thing.
01:24:41 Security Pacific l think is probably one
01:24:46 -You know about that?
01:24:49 That's right.
01:24:52 that suggested that the bank
01:24:55 though they managed to keep it of the wire,
01:24:58 But what links that to Kevin?
01:25:00 The police investigators that we interviewed
01:25:04 Based on what?
01:25:09 Based on what....
01:25:11 Just coincidence of things.
01:25:16 You've got to be kidding!
01:25:18 You used ''who else''
01:25:20 on the front page of the NewYork Times...
01:25:22 without even using
01:25:25 This was reported as fact
01:25:28 Just like NORAD, just like Kristy McNichol...
01:25:30 just like everything that made them
01:25:34 Let's look at the issue
01:25:36 lt wasn't mentioned
01:25:38 that Kevin was in solitary for 8 months
01:25:42 and that this above all
01:25:45 l mean, he didn't want to go back to jail.
01:25:47 Not just jail, solitary confinement.
01:25:50 Was he in solitary before?
01:25:53 1989.
01:25:54 He spent 8 months in solitary in 1989?
01:25:57 Wait. He didn't spend 8 months in prison.
01:26:03 You've written two books on the guy
01:26:06 You're somewhat of an expert
01:26:08 and you didn't know
01:26:10 Or even how long his sentence was?
01:26:13 For the record, Mitnick spent a year
01:26:16 eight months of which
01:26:19 plus another six months in a halfway house.
01:26:21 With the psychologists in town
01:26:24 locking Kevin in solitary
01:26:31 l think it's inhumane, and l think there are
01:26:36 Obviously if this person has been able
01:26:39 that they think he was doing
01:26:43 That's a real talent that's being wasted.
01:26:46 And, to lock him up, especially
01:26:50 We wouldn't treat an animal that way
01:26:52 And yet, this is a talented individual?
01:26:57 -lt's not right.Thank you.
01:26:59 Wait, he was in solitary
01:27:02 A large amount of the time. Eight months.
01:27:06 Yeah, that's pretty hard.
01:27:09 Okay. Markoff gains a point
01:27:13 Now, here's something interesting.
01:27:17 he communicated with an lsraeli hacker
01:27:20 who's believed to be the mastermind behind
01:27:24 Yet Markoff never wrote a story about him...
01:27:27 and didn't even followthrough
01:27:30 ln fact, none of the authorities
01:27:33 almost as if these crimes were really trivial.
01:27:36 Nowthat would be a great story,
01:27:39 l thought a lot about that.
01:27:41 l just haven't had time to do the reporting.
01:27:46 You're right. lt's probably a great story
01:27:50 -l should come to New York--
01:27:53 Jsz was supposedly the mastermind
01:27:57 l never knew what the relations were.
01:27:59 The only thing l could say that l knew..
01:28:02 was that jsz and Kevin...
01:28:06 were actively trading
01:28:08 That's what l knew.
01:28:14 lf you asked me
01:28:18 it was jsz provided the tools
01:28:21 But l have no idea if that's true.
01:28:24 No idea?
01:28:26 lsn't this what the book, series of articles,
01:28:31 what Kevin actually did?
01:28:33 l was amazed by what he didn't know
01:28:36 But there was more that he did know
01:28:40 But one interesting thing
01:28:43 You know, so much was made of the fact
01:28:47 They were used.
01:28:49 An American Express card,
01:28:52 was used in Raleigh within two days
01:28:58 So who used it?
01:28:59 -How did you find this out?
01:29:03 You're saying the credit card
01:29:05 and it was used after he was arrested?
01:29:08 There are indications that there was
01:29:12 who knewthis and may have been
01:29:15 All l'm saying is there's some evidence.
01:29:18 How come this wasn't in the book?
01:29:20 How come it wasn't in the book.
01:29:22 l don't know why
01:29:26 This was really getting annoying.
01:29:27 He didn't follow up on
01:29:31 and he didn't mention the fact
01:29:34 One more remark like that
01:29:39 Look how many people are standing here
01:29:43 Look at all these people.
01:29:48 Valuable coupons!
01:29:51 What are they doing now?
01:29:53 Oh, Kevin Mitnick!
01:29:55 The way that the Japanese wizard
01:29:59 Mitnick respected the Japanese wizard
01:30:02 On the other hand...
01:30:04 since the whole computer business
01:30:07 why should Mitnick suffer
01:30:12 namely the computer. So that's it.
01:30:14 -What do you think of computers?
01:30:16 Why?
01:30:18 Because they're not like feeling skin,
01:30:23 And one can get lost deeply in them.
01:30:26 My son, of course, is in that world.
01:30:29 These people are computerphiles
01:30:34 Hackers are all right
01:30:38 But the rest of it....
01:30:40 -This is bullshit.
01:30:42 This is such bullshit!
01:30:44 l like Chaos Computer Club, l like anarchy.
01:30:47 -You know Chaos Computer Club? -No, but l like the
01:30:49 He's never heard of it.
01:30:51 No, it's great. But Mitnick, it's ridiculous.
01:30:55 Look, an activist.
01:30:59 Look, a bag of artificial intelligence.
01:31:01 They're from the '80s but l still bought them.
01:31:05 lt's like the government's
01:31:08 lt's to create a hacker mythology so
01:31:13 and other stuff like that.
01:31:14 He hasn't done anything wrong. He hasn't
01:31:18 He's basically just like a scapegoat.
01:31:21 l think most of the kids that l hang out with
01:31:25 They understand.
01:31:29 Why would they have any reason
01:31:32 other than he's a total scumbag who....
01:31:34 You know, like WarGames, the hacking.
01:31:37 That guy! Didn't he break into
01:31:41 He's not accused of selling information,
01:31:44 he's just accused of copying files.
01:31:46 Three-and-a-half years in prison for that.
01:31:49 Yeah, cool, wow, all right, great. Register to vote?
01:31:52 You're an activist, too?
01:31:53 lmagine if somebody made a film
01:31:55 and they get this totally evil kind of guy
01:31:59 and take everything that you ever did and
01:32:04 Look, there he is cheating
01:32:10 Many interesting items
01:32:14 Street scene, one of the best places
01:32:17 Here on the street scene...
01:32:19 we've got newspapers, we got novels...
01:32:22 we got documentary calendars,
01:32:26 What sysadmin is gonna have dot slash
01:32:30 lt was cool. lt's about using SUlD
01:32:34 and keeping it in your home directory
01:32:38 pretending to be a lamer,
01:32:41 And then they go and do an ls....
01:32:43 But what sysadmin is gonna have dot slash
01:32:48 l don't know man, some of those hackers...
01:32:51 when l'm on my computer
01:32:54 -Like what?
01:32:56 All these messages. Makes my computer--
01:32:58 -Are you onAOL by any chance?
01:33:02 We've been bending over backwards
01:33:04 and he's only one point away
01:33:07 Let's do an easy one, the film.
01:33:09 Everyone hates the film, right?
01:33:11 When l read the screenplay...
01:33:14 l was mostly just disappointed because
01:33:19 There we go. He's back in the running.
01:33:21 With one clip to go,
01:33:25 So l gave him a chance
01:33:27 l asked him to help us help Kevin
01:33:30 to get him released from prison
01:33:34 He didn't want to sign the petition
01:33:38 lf you could pass a message to Kevin...
01:33:41 and say if he'd be willing to sit down
01:33:46 l would love to do a piece.
01:33:53 lf nothing else,
01:33:56 More than a decade of writing about Kevin
01:34:00 lt was time for our last corporate visit.
01:34:01 lt was time for our last corporate visit.
01:34:02 Novell, who claimed Kevin
01:34:07 We went to their corporate headquarters
01:34:10 Okay, nowthe road says ''180 East.''
01:34:14 All right, we want 122 East, 1700 South.
01:34:19 lt's like some locker combination.
01:34:23 Okay, here we are.
01:34:26 ls there somebody
01:34:29 The person in charge of security is....
01:34:35 He's just brand-new
01:34:36 Check that out. This guy is so worried
01:34:40 that he went through this acrobatic act
01:34:45 But in the end,
01:34:49 Nobody was allowed to say anything.
01:34:53 But, at least, we tried.
01:34:57 Hey, pal, look down. Whoops!
01:35:01 So the last corporate door
01:35:04 And now we had one last task...
01:35:05 And now we had one last task...
01:35:06 to head across the country
01:35:09 We knew it wouldn't work.
01:35:12 That's what hacking's been about
01:35:15 Doing things that you knew wouldn't work,
01:35:18 And trying to ignore the shit
01:35:21 and trying not to feel bad
01:35:24 As we drove from state to state...
01:35:27 l thought of how bad it could get,
01:35:30 l remembered what they do
01:35:33 l remembered what they did to Bernie.
01:35:36 The Bernie S. case,
01:35:38 got blown out of proportion
01:35:41 lt got blown out of proportion
01:35:44 who knew what exactly he had done
01:35:49 was almost to make him look like the guy
01:35:54 To do that was an incredible leap.
01:35:58 They made Bernie S.
01:36:01 The new statute that my attorney
01:36:06 that, in fact,
01:36:10 makes it a federal felony to possess...
01:36:14 hardware or software...
01:36:16 for the modification
01:36:19 for the unauthorized access
01:36:22 l wasn't accused or alleged
01:36:26 or ever cloned a cellular phone
01:36:29 Just the mere possession of these things...
01:36:32 now constituted a federal felony
01:36:35 The judge ordered me held without bail...
01:36:38 based on the fact that books...
01:36:40 in fact, l think l had two books in my home...
01:36:44 on howfireworks, explosives are made.
01:36:48 l had about 2,000 books
01:36:51 What little media attention the case got
01:36:55 He had never stolen anything,
01:36:57 Everything used to make him look
01:37:01 When the Secret Service wants you
01:37:05 Not even a judge.
01:37:06 ''Your Honor, when we initially searched
01:37:11 ''federal agents discovered a substance...
01:37:15 ''they believed to be C4 plastic explosives.
01:37:20 ''While upon later analysis...
01:37:23 ''it turned out not to be C4...
01:37:25 ''the fact that it might have been
01:37:28 ''And, based on that,
01:37:33 The judge didn't even blink
01:37:35 Then the prosecutor made
01:37:39 She told him
01:37:41 to prosecute this case
01:37:44 and that, in fact, the real reason,
01:37:48 ''the real reason'' Ed is in jail...
01:37:52 was not because of crystals or software
01:37:56 lt was because of other things
01:38:00 Namely:
01:38:02 surveillance photographs
01:38:07 So l made these photos available
01:38:10 and it apparently was a coincidence
01:38:14 but the local Fox television affiliate...
01:38:17 Fox 29 in Philadelphia, their news division,
01:38:21 Most are between their mid-teens to late 20s.
01:38:24 They gather every Friday night
01:38:27 lt's called the 2600 meeting,
01:38:31 and meetings like these are advertised...
01:38:33 in a hi-tech magazine
01:38:35 Some hackers call themselves ''fighters
01:38:39 The US Secret Service
01:38:41 But hackers say
01:38:44 ln this photograph the Secret Service agent
01:38:48 The Secret Service didn't find it humorous.
01:38:50 Not only did they have
01:38:53 but they were picking their noses
01:38:59 We all thought that was amusing...
01:39:02 until l was in federal prison...
01:39:04 and l found out that the real reason
01:39:09 For a year-and-a-half...
01:39:10 Bernie was bounced around maximum
01:39:15 l think they got tired
01:39:17 because l found myself in handcufs
01:39:23 Lehigh County Prison
01:39:27 amongst prisoners l had talked to
01:39:32 as probably one of the roughest prisons
01:39:35 Within a day, Bernie was attacked.
01:39:37 He punched me in the mouth
01:39:41 He was a big guy,
01:39:46 and l think it turned out later
01:39:49 coming down off crack or something.
01:39:53 l went down and he started
01:39:57 and l put my arm up to block his kick
01:40:00 After bleeding for hours,
01:40:04 but the authorities refused
01:40:07 The hospital wanted me to sign this waiver.
01:40:10 Whenever you go into surgery
01:40:13 that you understand all the risks involved.
01:40:16 l said, not until l get a hold of my uncle...
01:40:19 or at least let somebody in my family
01:40:23 The prison officials went bananas
01:40:26 lt was a liability for them
01:40:31 l was severely injured and
01:40:35 lt got all the way up to
01:40:39 My uncle was a known person
01:40:42 He'd been the president of the city council.
01:40:45 He wasn't someone who'd run down there
01:40:50 Meanwhile, l was handcuffed and shackled...
01:40:53 to the hospital bed, which was ridiculous.
01:40:58 l was in bad shape.
01:41:01 With a guard sitting there with a gun...
01:41:04 making sure that l didn't break
01:41:07 l was denied antibiotics for two days.
01:41:11 l was denied any painkillers at all...
01:41:14 not even aspirin which l couldn't take
01:41:18 and l was probably in
01:41:22 that l've ever had,
01:41:25 having multiple fractures.
01:41:30 lt was like being in an altered state
01:41:35 They weren't bringing me food l could eat.
01:41:37 They brought solid food which
01:41:41 l was getting to the point where....
01:41:44 l was starting to feel like,
01:41:49 l was really feeling like, ''l give up.''
01:41:52 l was losing my will to go ahead.
01:41:55 l was able to get a phone call out
01:41:57 tell people where l was, what was going on.
01:42:00 And that was when
01:42:04 and lnternet crusade started...
01:42:08 gaining momentum.
01:42:10 We had state representatives getting called.
01:42:15 and they called saying, ''What's with this?
01:42:19 Finally, the prison and the judge realized
01:42:23 They wanted to get this thing over with
01:42:29 signed an order to have me released
01:42:32 which the guards had
01:42:35 They said, ''What is that? People die here.
01:42:38 So this was an unusual thing.
01:42:43 that all the publicity
01:42:47 the lnternet, their website...
01:42:50 radio interviews,
01:42:53 l'd been repeatedly interviewed
01:42:58 with Emmanuel Goldstein...
01:43:00 and people were following this case
01:43:02 and it was generating a lot of attention
01:43:06 l got letters, l got hundreds of letters.
01:43:09 We had gotten him out
01:43:12 And the scars were permanent.
01:43:14 They had to put a....
01:43:16 The surgeons mounted...
01:43:19 a titanium bar in my arm.
01:43:23 l don't know if you can see it or not.
01:43:26 A nice scar from here to here
01:43:31 and seven stainless-steel screws.
01:43:35 That's it. That's my full range of motion
01:43:39 Unlike my good arm which straightens out.
01:43:43 My jaw doesn't open as much as it used to.
01:43:47 lf l'm trying to bite an apple,
01:43:51 But l live with it.
01:43:55 We crossed the entire country and
01:43:56 We crossed the entire country and
01:43:59 But there was a problem.
01:44:01 lt seems that the hurricane...
01:44:05 is making a beeline for the set
01:44:10 ln fact, it's estimated that it will reach
01:44:15 And, that's something
01:44:17 because it's not like that's something
01:44:20 l fear that one of the listeners
01:44:25 may have called upon almightyAllah...
01:44:28 or Christ or whatever...
01:44:30 to rain forth upon these people
01:44:35 l'd like to stress at this point
01:44:38 That's not exactly how
01:44:41 l fear that the Takedown people
01:44:46 lf you look at the map,
01:44:50 you will see the eye of the hurricane,
01:44:55 you will see a little dot that indicates
01:44:58 That is where it's heading.
01:45:02 where the rival gangs of twister watchers
01:45:06 ''This is the big one!''
01:45:08 They were looking at this thing...
01:45:10 and they saw another hurricane
01:45:13 And they say they've never seen that before.
01:45:16 And, if that's not enough for you,
01:45:20 Bonnie is the name
01:45:23 Nowthe metaphor just could not
01:45:27 Of course, we didn't take our own advice
01:45:37 We thought we might be able to get
01:45:41 We were right.
01:45:49 They seemed to have a real fixation
01:45:53 You had to wonder what had happened.
01:45:58 We took a little tour of the restricted area
01:46:11 The storm passed.
01:46:12 And while we were exploring the next day...
01:46:15 we made a discovery.
01:46:18 And they all want Free Kevin stickers.
01:46:21 lf you give me some, l will send it to them.
01:46:25 Was it really this easy?
01:46:27 Had we discovered where
01:46:29 through our own bumper sticker?
01:46:31 -l have Mr. Wong in Number 9.
01:46:33 Yeah. He's in Number 9.
01:46:35 -ls he still here?
01:46:38 The receptionist went out of her way
01:46:41 And while the guy playing
01:46:44 we found the producer who promised us
01:46:48 The place was swarming with celebrities...
01:46:50 like cast members from Dawson's Creek
01:46:54 We wandered around town,
01:46:58 seeing the desperate people.
01:47:00 We witnessed civilization
01:47:11 Roads were closed...
01:47:14 power was out...
01:47:20 trees were knocked down.
01:47:23 But it didn't matter.
01:47:25 We were going to finally talk
01:47:30 There was nothing to do,
01:47:33 We had four days to kill
01:47:36 to see the town where Kevin Mitnick
01:47:38 The cellular towers where Markoff
01:47:42 And this was the apartment complex
01:47:45 And this was Kevin's actual apartment.
01:47:48 -You have a computer yourself?
01:47:50 Be careful.
01:47:51 l'll keep that in mind.
01:47:53 We foundTakedown crew members in
01:47:57 You have to remember that
01:48:02 Skeet is definitely.... He's a great actor.
01:48:07 He's the most natural actor,
01:48:11 He's very charismatic.
01:48:13 There's nothing you can do to Skeet Ulrich
01:48:17 So that's kind of, l mean,
01:48:20 he's lucky, you know?
01:48:22 l promised to tell Kevin how lucky he was
01:48:25 But now it was time for our interview.
01:48:28 We had been in North Carolina for five days.
01:48:30 But something was wrong.
01:48:32 Miramax had changed their mind
01:48:35 So we staged an impromptu protest
01:48:38 And as we were leaving,
01:48:42 This time we wouldn't let them escape.
01:48:42 This time we wouldn't let them escape.
01:48:46 We drove next door
01:48:52 There he goes. Yeah.
01:48:57 And off he goes into the wild blue yonder
01:49:01 This is the realTakedown!
01:49:07 We had two cars on our side...
01:49:09 we would outflank them, chase them,
01:49:24 -l wish l didn't have these running lights.
01:49:29 For six weeks
01:49:31 and we hadn't even gotten
01:49:34 So this is what it came down to:
01:49:35 A cat-and-mouse game
01:49:38 They didn't know
01:49:41 He's making a U-turn.
01:49:44 He's making a U-turn, that motherfucker
01:49:47 -Oh, God.
01:49:49 -Man, there's a boat in the way.
01:49:53 What do we do now? This is just great.
01:49:55 This is just so typical North Carolina-ish.
01:49:57 Fucking boat blocking us on the street.
01:50:00 -He's not there.
01:50:05 This guy's good.This guy's real good.
01:50:13 They took off that way.
01:50:16 They made a U-turn
01:50:18 Really? That's why.
01:50:20 -Did they then go that way?
01:50:22 After they made the U-turn?
01:50:24 They left the gas station and went that way?
01:50:27 -They went that way.
01:50:29 A few minutes ago. l waited.
01:50:31 l thought maybe you'd come by
01:50:33 So they're headed that way
01:50:36 So let's go.
01:50:37 -Where are we gonna go?
01:50:38 Even if we go forward at maximum warp...
01:50:41 we can't catch them
01:50:44 Let's face it guys, we lost. They beat us.
01:51:01 -Shakes?
01:51:03 Shakes.
01:51:04 There's always the outside chance
01:51:08 We had failed.
01:51:09 We never found Shimomura...
01:51:11 we never got to talk
01:51:14 and we never got past the lobby
01:51:18 Worst of all, Kevin was still in prison.
01:51:21 1999 sawthe Free Kevin Movement
01:51:22 1999 sawthe Free Kevin Movement
01:51:26 The media wouldn't cover it,
01:51:36 And for the first time...
01:51:37 hackers marched in the streets
01:51:41 even overseas in England and Russia.
01:51:44 lt was an amazing spectacle...
01:51:45 and more people learned
01:51:51 Even though Kevin Mitnick saw
01:51:55 we felt like we were getting somewhere.
01:51:59 Excuse me? What are you doing?
01:52:03 And in the end,
01:52:06 to avoid spending
01:52:11 You're watching Southern California's
01:52:16 Good evening. l'm Gretchen Carr.
01:52:19 And l'm Michael Tuck. Up front at 6:30...
01:52:21 a guilty plea by notorious computer hacker
01:52:25 Juan Fernandez joins us live...
01:52:27 from the Federal Courthouse
01:52:29 He was the first computer hacker...
01:52:31 to make it to the FBl's Most Wanted List.
01:52:33 And after a long battle
01:52:36 the 35-year-old man
01:52:39 His computer crimes apparently
01:52:44 although Kevin Mitnick
01:52:48 ending a four-year battle
01:52:51 This is a very serious crime.
01:52:52 The federal government
01:52:54 We will prosecute hackers...
01:52:56 particularly when they cause
01:52:59 Mitnick nowfaces 46 months in jail.
01:53:02 He's already served eight months,
01:53:05 with good behavior, Mitnick
01:53:10 Mitnick will pay for his crimes
01:53:12 Although his attorneys say
01:53:14 to pay restitution
01:53:17 that doesn't mean
01:53:19 lt was as if we hadn't said a word.
01:53:23 l pray that they never wind up
01:53:29 l pray that nobody does.
01:53:31 But the thing is that if they do...
01:53:35 right nowthe way it stands,
01:53:39 lt's not about fairness.
01:53:40 lt's just about the way
01:53:44 lt's crazy to bring up
01:53:47 because there's no comparison here...
01:53:48 but here's a case where a defendant
01:53:52 and look what that legal team accomplished.
01:53:54 l'm not saying you need a lot of money
01:53:57 l'm saying it doesn't matter
01:54:00 The case, the legal system...
01:54:02 the justice system isn't about what you did
01:54:05 lt's about either the government
01:54:08 or you'll win the case.
01:54:10 That's all that matters in the case.
01:54:13 l'm just saying in the court system,
01:54:16 The prosecution will do
01:54:18 spend whatever money they can
01:54:21 and you have to do the same thing
01:54:24 You know, this is no longer
01:54:27 This is about how do you make it
01:54:32 to get them to roll over or cop a plea.
01:54:35 lt has nothing to do with justice anymore.
01:54:38 God help you
01:54:40 because it's very easy to get in...
01:54:42 and it's almost impossible
01:54:47 because you're up against an adversary...
01:54:52 that has everything going for it
01:54:57 And, unfortunately,
01:55:01 So, that's the way it is.
01:55:05 lf the legal community
01:55:09 we're gonna have more people locked up...
01:55:12 than we know what to do with.
01:55:16 A lot of them are going to be kids.
01:57:22 l don't think it ended.
01:57:23 lt turned into this huge controversy
01:57:26 But there weren't any more stories
01:57:31 What would you think
02:01:05 l appreciate everybody taking the time
02:01:05 l appreciate everybody taking the time
02:01:08 which was a tremendous effort
02:01:11 and everyone on the 2600 staff.
02:01:15 And l want to offer...
02:01:16 my sincere appreciation and gratitude...
02:01:20 for the tremendous moral support
02:01:23 throughout this five year ordeal.
